NOTICE OF SALE UNDER POWER
Because of a default under the terms of the Security Deed executed by
O. Marcus Bell
to
Mortgage Electronic Registration Systems, Inc.
as nominee for Allied Home Mortgage Capital Corporation dated June 24, 2008, and recorded in Deed Book 1503, Page 215, Thomas County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. by Assignment, securing a Note in the original principal amount of $156,005.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, November 3, 2015, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
Legal Description of Tract 24 (2.296 acres) of a Subdivision developed by Gordon R. Brent in Land Lot 82 of the 13th Land District, Thomas County, Georgia (nka 127 Brentwood Drive, Thomasville, GA 31757) All that tract or parcel of land situate, lying and being in Land Lot 82 in the 13th Land District of Thomas County, Georgia, more particularly described as Tract 24, consisting of 2.296 acres, according to a plat of survey prepared for Gordon R. Brent by E. L. Carter dated April 25, 1978, revised on March 30, 1979, and recorded in Plat Cabinet 3, Folio 91-A, as follows:To reach a point of beginning, commence at the point formed by the intersection of the West margin of Hall Road with the South original land lot line of Land Lot 82 and run thence North along the West margin of said road 1,410.5 feet to a point, which point is formed by the intersection of the West margin of Hall Road with the South margin of a road now known as Brentwood Drive; run thence North 88 degrees 24 minutes West 436.0 feet on the South margin of Brentwood Drive to THE POINT AND PLACE OF BEGINNING of the property being conveyed. FROM SAID POINT AND PLACE OF BEGINNING, run thence North 88 degrees 24 minutes West on the South margin of Brentwood Drive 200.0 feet to a point; run thence South 01 degrees 20 minutes West 500.0 feet to a point; run thence South 88 degrees 24 minutes East 200.00 feet to a point; run thence North 01 degrees 20 minutes East 500.00 feet to THE POINT AND PLACE OF BEGINNING on the South margin of Brentwood Drive.The above-described property is conveyed subject to the restrictions imposed in a deed from Gordon R. Brent to Donald W. Clemons and Cornelia Clemons, dated March 28, 1977, and recorded in Deed Book 103, Pages 114-116, in the office of the Clerk of the Superior Court of Thomas County, Georgia, and by reference thereto the same (to the extent they are applicable hereto) are incorporated therein and made a part hereof. Said restrictive covenants are hereby madeapplicable to the above tract of land but shall not apply to or affect any other land or lands adjacent thereto, except as set forth in said restrictive covenants above referred to. The lot front shall be on Brentwood Drive.Insofar as the same may be applicable, the above-described property is conveyed subject to power line easements from Emma W. Duren to Georgia Power Company recorded in Deed Book 66, Page 327, and Deed Book 66, Pages 328-329, and an electric line easement from D. C. Duren to Grady County Electric Membership Corporation recorded in Deed Book 5-S, Page 271, and all the terms of the right of way conveyance from Gordon R. Brent to Thomas County, Georgia, dated April 18, 1979, for Brentwood Drive, Lawrence Drive and drainage easements recorded in Deed Book 126, Pages 571-573, all in the office of the Clerk of the Superior Court of Thomas County, Georgia.
Said property is known as 127 Brentwood Drive, Thomasville, GA 31757, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of O Marcus Bell, a/k/a Oscar Marcus Bell, Oscar W. Bell, and Representative for the Estate of O. Marcus Bell, successor in interest or tenant(s).
